Please read these Terms of Use carefully. They govern your access to and use of this corporate and bulk gifting catalogue operated by Quest Retail Private Limited (The Body Shop India). By accessing or using the site, or by submitting a gifting enquiry, you agree to these Terms.

1. Who operates this site

This gifting catalogue is operated by Quest Retail Private Limited, the master franchisee for The Body Shop brand in India. In these Terms, “we”, “us” and “our” mean Quest Retail Private Limited. “You” and “User” mean the person accessing or using the site.

References to The Body Shop, its brand names, products, trade marks or other brand assets do not mean that The Body Shop International Limited or any other affiliate is automatically a party to these Terms.

2. Access, eligibility and authority

The public catalogue is accessible to visitors who have the site link. No customer registration, user account or password is required to browse the catalogue or submit an enquiry.

You should be at least 18 years old and legally capable of providing the information and making the representations you submit through the site.

If you submit an enquiry on behalf of a company, employer, client or other organisation, you confirm that you are authorised to provide the information submitted and to communicate with us on that organisation’s behalf.

3. Shortlists, enquiries, quotations and orders

Adding a gift or product to a shortlist does not reserve stock, guarantee availability, fix a price or place an order. A shortlist is only a planning feature.

Submitting an enquiry is a request for information or a quotation. It is not an order, does not create a sale or purchase on the website and does not oblige either you or us to proceed.

If you decide to proceed, our gifting team may issue a quotation, proposal, order confirmation or other commercial document. The point at which a binding order is formed, and the terms governing that order, will be as stated in the applicable quotation, order confirmation, invoice and/or other written commercial terms agreed between the parties.

Any subsequent sale or supply is therefore separate from the website browsing and enquiry process and may be subject to additional terms covering pricing, payment, taxes, delivery, customisation, cancellation, replacements and other commercial matters.

4. Prices and quotations

Prices displayed on the catalogue are regulated under Legal Meteorology Act 2009, Legal Meteorology (Packaged Commodities Rules) 2011 and the Cosmetic Rules, 2020 and are provided for planning and enquiry purposes. Unless expressly stated otherwise, displayed product prices refer to the applicable MRP (Maximum Retail Price inclusive of applicable taxes) and do not constitute an offer to sell at that price.

Your final invoice value may depend on quantity, product availability, packaging, personalisation or branding, delivery location, delivery timeline, taxes and other requirements. The applicable total invoice value will be confirmed in the quotation or other written order document.

MRP or product pricing may vary between batches, manufacturing or import periods, channels or specific SKUs. The MRP declared on the physical product or applicable SKU will prevail .

5. Product information, images and availability

We take reasonable care to present products and gifts accurately. However, photographs, screen colours, packaging, labels, promotional sleeves, components or presentation may differ from time to time because of batch changes, manufacturer updates, stock availability or display settings.

Product ingredients, formulations, dimensions, weights, packaging and other specifications may also change in accordance with applicable laws. Information, warnings, ingredients and directions shown on or supplied with the actual product should be reviewed before use.

Catalogue availability is not guaranteed. A product appearing on the site may be unavailable when you enquire or when a quotation is prepared. Where a proposed or confirmed order requires a material change to product, specification, size, colour, unit count, weight or gift composition, we will communicate the change and, where appropriate, seek your approval before proceeding.

Where a gift is described as customisable, component choices remain subject to availability and any limitations stated in the quotation or order confirmation.

6. Packaging, personalisation and customer-supplied artwork

Gift packaging and presentation may vary according to the selected gifting option, quantity, availability and agreed personalisation. Environmental or product-design considerations may mean that some individual products do not include extra seals, inner lids or secondary packaging.

If you provide a logo, trade mark, artwork, name, message, image or other material for personalisation, you confirm that you are authorised to use and provide that material for the requested purpose and that our use of it as instructed by you will not infringe the rights of another person.

You are responsible for checking and approving proofs, spellings, artwork, placement and other customisation details before production where an approval is requested. Final customisation requirements, approval processes and charges will be governed by the applicable quotation or order confirmation.

7. Lead times, delivery and special stock disclosures

Any lead time, dispatch period or delivery estimate shown on the site is indicative only. Final timelines depend on quantity, stock, personalisation, packaging, delivery location and other order requirements and will be confirmed in the applicable quotation or order confirmation.

Where a particular gifting offer involves surplus, clearance, short-dated or otherwise specially disclosed stock, the relevant condition, including any material shelf-life information, will be communicated for that offer or order rather than applying automatically to every product shown on this catalogue.

8. Referral links and employee codes

Where the site records a referral link, employee name, employee code or other referral identifier, it is used for internal attribution and reporting. A referral does not by itself create a discount, commission, entitlement or contractual right for the person making the enquiry unless we separately confirm otherwise in writing.

9. Acceptable use

You agree to use the site lawfully and reasonably. In particular, you must not:

The Body Shop trade marks, logos, product names, brand assets and other related intellectual property displayed on the site belong to The Body Shop International Limited and/or the relevant rights holder or licensor, as applicable.

The catalogue design, local copy, photographs, graphics, databases, software and other site materials may be owned by Quest Retail Private Limited, The Body Shop International Limited and/or their respective licensors or content providers, depending on the material. All rights are reserved by the relevant owner.

You may view the site and make reasonable copies or printouts for your own internal gifting evaluation or personal reference. You may not reproduce, adapt, publish, assign, distribute, modify, sell, license, create derivative commercial materials from, or otherwise exploit protected site content or trade marks without the prior permission of the relevant rights holder, except where applicable law expressly permits it.

11. Third-party links and communication services

The site may contain links to third-party websites or allow you to communicate using third-party services such as WhatsApp or email. We do not control unrelated third-party websites or services and are not responsible for their content, security, availability or privacy practices. A link does not necessarily mean that we endorse the third party. You should review the terms and privacy information applicable to the third-party service you choose to use.

12. Product safety

Cosmetic and personal care products may contain ingredients that may cause sensitivity or an allergic reaction. Users and gift recipients should review the product label, ingredients, warnings, directions and suitability information before use and should seek appropriate professional advice where they have a known allergy, sensitivity or medical concern.

Where gifts are distributed to employees, clients, event attendees or other recipients, the purchaser should ensure that product information and warnings remain available to recipients. We can provide or guide you to available product information on request.

13. Site information and availability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any statutory rights or remedies that apply notwithstanding these Terms.

Liability relating to a confirmed commercial order, including the supply, payment, delivery or agreed customisation of goods, will be governed by the applicable quotation, order confirmation, invoice and any additional written commercial terms for that order rather than by this website-use clause alone.

15. Misuse of Website and Indemnity for misuse and unauthorised materials

You agree not to use the Website for any unlawful, fraudulent or unauthorised purpose, or in any manner that may damage, disable, overburden or impair the Website or interfere with its operation or with another person's use of the Website.

You must not attempt to gain unauthorised access to the Website, its systems or any data, introduce malicious code or interfere with any security or technological feature of the Website.

To the extent permitted by applicable law, you will be responsible for losses or costs reasonably incurred by QRPL to the extent directly resulting from your wilful or unlawful misuse of the Website or your material breach of these Terms, except to the extent caused by QRPL's own act or omission.

To the extent permitted by applicable law, you agree to indemnify and hold harmless QRPL from third-party claims and reasonable costs directly arising from your unlawful use of the Website or your material breach of these Terms, except to the extent such claim or loss results from QRPL's own act or omission.

16. Privacy

Our Privacy Policy explains how personal information submitted through or generated by use of the catalogue is handled. By submitting an enquiry, you acknowledge that you have had the opportunity to read the Privacy Policy.

Any separate option to receive marketing communications is voluntary and is not a condition of our responding to your gifting enquiry.

17. Changes to these Terms

We may update these Terms from time to time to reflect changes in the catalogue, our processes or applicable law. Updated Terms become effective when published on the site with a revised effective date. Your continued use of the site after an update is subject to the updated Terms.

18. Events beyond our reasonable control

We are not responsible for failure or delay in the operation of the site caused by events beyond our reasonable control, including internet or telecommunications failures, utility outages, cyber incidents affecting third-party infrastructure, natural disasters, government action, civil disturbance or similar events. Any force majeure arrangements for a confirmed order will be governed by the applicable order terms.

19. General provisions

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Our failure or delay in enforcing a provision does not amount to a waiver of that provision or any other right.

Nothing in these Terms creates a partnership, agency, employment relationship or joint venture between you and Quest Retail Private Limited.

Headings are included for convenience and do not limit the interpretation of these Terms.

20. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to any rights or forums that cannot lawfully be excluded, disputes relating specifically to use of this site or these Terms will be subject to the exclusive jurisdiction of the competent courts at Gurugram , India.
